This agreement applies to people who have applied to a campaign in the Boostified App.

1. Terms of assignment

These terms (the "Terms of Service") govern your participation in any campaign created by a customer to Boostified (the "Customer") and which you may offer to participate in through Boostifieds platform (the “Campaign”). By accepting your participation in the Campaign, you confirm that you have read these terms and conditions and commit to Boostified to perform the Campaign in accordance with the Terms of Assignment and the specific conditions set for the Campaign (the "Campaign Terms").

Please note that you are not employed by Boostified when performing the Campaign unless explicitly stated.

When participating in the Campaign, you must perform assigned tasks in a careful and faultless way. When participating in the Campaign, you must always make the best use of Boostified's and the Customer's interests. It is of the utmost importance for both Boostified's and the Customer's business that you are service-oriented and also, in every other way, a god representative for Boostified and the Customer, and that you understand that this is an important prerequisite for your participation in the Campaign. You are expected to stick with the equipment that the Campaign states is necessary to complete the task.

2. General Terms and Conditions for Participation in the Campaign

By participating in the Campaign, you agree to abide by the following terms:

You must publish the number of posts that appear in the Campaign Terms, and the post / posts must be published before the agreed deadline, unless otherwise decided.

The brand must be clearly visible in the post.

You must use the hashtags and mentions set forth in the Campaign Terms and these must be included in the copy, ie. not in the comments field.

You must clearly identify your post(s) as advertising, and state that the publication takes place in collaboration with the Customer.

The post must be up for at least three (3) months.

The post must be published separately from other collaborations and if you make an album with multiple images / videos, the product should appear on the first image / video.

You may only display the Product / Service of the Campaign and not have other competitors trademarks in the image.

You may not make your account private during the Campaign and for three (3) months thereafter.

3. Intellectual property rights and liability for published material

All copyright to such material that you create upon your participation in the Campaign (the "Material") goes to you. In your publication of the Material within the framework of your participation in the Campaign is responsible you to:

you hold all rights to the Material;

the publication of the Material does not violate any law or infringe any the rights of others and you have obtained the proper consent of any person depicted as appears in the Material in accordance with the Act (1978: 800) on names and images in advertising.

By publishing Material in the Campaign, you grant Boostified an eternal, irrevocable, global, royalty-free, transferable and non-exclusive right to use the Material in accordance with what appears from these Terms of Assignment (the "License"). The license applies only Boostifieds and / or the Customer's publication of the Material on their social media and platforms for the purpose of marketing Boostifieds and / or the Customer's brands, products and / or services.

You waive your right to be named as the author of the Materials published by Boostified or the Customer with the support of the License, but the License provides Boostified and the Customer a right to use your name in such publication.Boostified and the Customer have the right to edit, cut and make other changes in The material published with the support of the License.

No additional compensation other than that paid in accordance with paragraph 4 below shall be paid for the transfer of a license or publication that takes place with the support of the License. Neither Boostified or the Customer shall be deemed to have no obligation to publish the Material.

You are responsible for all direct damage caused to Boostified and / or the Customer as a result of the Material provided that the damage was caused by conditions under your control, for example, if the Material created by you infringes the rights of third parties. This liability applies regardless of whether the damage is caused by your, Boostifieds or the Customer's publication of the Material, but not if it is Boostifieds or the Customer's changes to the Material that alone caused the damage.

To avoid misunderstandings, the License will not expire in the event you delete your Boostified account.

4. Compensation and tax

After completing the tasks assigned to you when participating in the Campaign, you will receive the compensation that you have agreed on with the Customer at each individual accepted mission. The compensation usually consists of a product / service that you are provided directly with the customer. You are aware that Boostified is not responsible for the compensation or its publication, and that the compensation to be paid for the Campaign is agreed directly between you and the Customer.

You are responsible for reporting and paying any tax that accrues on that compensation provided to you for your participation in the Campaign.

5. Confidentiality

You undertake that both during your participation in the Campaign and thereafter without limitation in time to observe confidentiality about Boostifieds and the Customer's affairs and others circumstances that you have become aware of as a result of your participation in The campaign and which due to the nature of the matter should not come to third parties knowledge (“Confidential Information”), such as the content of these Terms of Service and the Campaign Terms set forth for the Campaign in question, unless such obligation exists according to forced laws or government decisions. Your commitment to Confidentiality applies regardless of the form in which you received the Confidential Information, and regardless of whether it was received from Boostified or directly from the Customer. Your right to use the Confidential Information relates solely to the conduct of the Campaign and ceases as soon as your participation in the Campaign is completed in accordance with point 6 below. The is not allowed to copy or reproduce Confidential Information without Boostifieds prior written consent.

6. Assignment time

Your assignment for the Customer due to the Campaign ends without prior notice notice period and without further compensation after you have fulfilled your obligations in accordance with these Terms of Service and the Campaign Terms.

This agreement applies to people who are registered in Sweden.

Salary and employment

When you are enrolled in a campaign administered by Boostified, you have your employment in Boostified AB, which handles employer responsibility and payroll administration. Thus, it is Boostified AB that deducts tax and pays employer fees in accordance with current Swedish rules and regulations.

However, if you have applied to a campaign that is administered by another company, it is instead they who handle employer responsibility and payroll administration. You can see who's responsible for a campaign in the step where you confirm your application. The app also has a function under "My Campaigns" called "Campaign History". With it, you can easily keep track of the campaigns you have participated in and who has been responsible for them.

We want to emphasize that how other companies choose to handle taxes and fees is not something that Boostified AB is responsible for.

Holiday pay

When your salary is paid, you also receive your holiday pay, which is 12% of the gross salary. You therefore need to save money each month for your holiday.

The GDPR (Data Protection Ordinance) is a new EU regulation that will begin throughout the EU on 25 May 2018. GDPR replaces the Swedish Personal Data Act (PUL). Much is alike, but it means that the requirements for how companies and organizations can process your personal data is sharpened.

Within Boostified, we treat Personal Information for users and customers in our secure database through Heruko on Amazon.com. We protect your privacy and comply with applicable laws that are intended to protect you as an individual. Boostified AB is the personally responsible person for the processing of personal data on this database. For information about how to contact us, see the heading Contact us at the top of the page.

“Personal Data” means any information that may be linked directly or indirectly to a living person today.

Boostified uses Personal Information primarily to administer, provide, develop and maintain the Services, process your bookings, optimize your experience of the Services, and personalize your communication with you. Please read this Privacy Policy carefully to understand how and for what purposes we treat your Personal Information. By submitting your Personal Information to us and accepting the applicable terms, you agree that your Personal Data is processed in accordance with the terms of this Privacy Policy. If the law requires more specific consent from you, we will of course ask for one.

Changes to these now-mentioned Terms and Conditions are announced by publishing the new Terms and Conditions on the Boostified website, and we therefore recommend that you regularly review them. If you add Personal Data about other persons, you are responsible for Boostified’s processing of Personal Data in accordance with applicable terms.

What do we store about your company?

We store your brand name, company name, email address, phone number, name, and information you provide in the campaigns you create in the platform, such as product information, images & hashtags.The data we store on our platform is used / may be used to:

• Create user accounts for accessing our services

• Identify you when you log in to our services

• Offer your personal content in our services

• Contact you by phone or by email / automatic mail

• Create internal overviews and to keep internal statistics

• Create internal statistics or aggregated data that may be used for presentations / events

• Create invoices

• View campaigns and its information for registered influencers

What do we store about our members?

If you register at login.boostified.se, we collect your data in order to perform our services. We store full contact information in the form of date of birth, name, age, gender, mobile number, address. See full list below.

We will keep your information updated to deliver as personalized, relevant communication to you as possible. As a Boostified’s member, you will receive newsletters with Boostified’s offers and news. You can at any time choose to unsubscribe from our newsletter by link in the newsletter. You can also choose to unsubscribe from your Boostified membership at any time by emailing info@boostified.com If you are a Boostified Platform member, the data is registered as long as you choose to remain a member.We also use personalization in our communications through social media and web advertising on other websites.

How can you exercise your rights under the GDPR?

According to the general data protection regulation, you have the right to access, correct, export and delete your data.

Data storage and deletion of account

We store information until it is no longer necessary to provide our services, or until your account is deleted, whichever comes first. When you delete your account, we delete data that can be traced back to you. Information that others have shared about you is not included in your account and will not be deleted.

Boostified uses cookies and local storage to provide you with a good experience of our services. It’s about small files of information stored on your computer when you visit our services.

For example, cookies / local storage is used to log in to our services and access your personal content. We also use cookies for tools that collect statistics about how our services are used.

You can disable the use of cookies by changing the settings for cookies in your browser, but unfortunately, we can not guarantee that our services will work as intended if you do not have cookies enabled.

What cookies are used?

Most of the cookies we use are automatically deleted from your computer when you close your browser (end of session). These cookies are therefore called for session cookies. What information is stored in cookies?

These terms and conditions constitute the agreement between Boostified AB, 559091-6754 (“Boostified”, “we”, “our” or “us”) and you (“you”, “you”, “your”, or “member” “). By signing up on our platform, you accept our terms and conditions, so it is essential that you read the content carefully before signing up. The purpose of Boostified’s services is to help members, brands and agencies find a PR collaboration. This Privacy Policy aims to clarify and explain what kind of personal information our services collect and store, as well as use.

When you become a member, either a private individual or a company, you have probably received an invitation from us, or you have registered yourself after entering our landing page.

In order to register as a member, you must have an Instagram account that you authorize when logging in to login.boostified.com, without this procedure you can not register. We do not accept members under the age of 18.

You are responsible for complying with all the terms and conditions that are contained in this agreement as well as for each campaign request you accept. In case of breach of Boostified’s terms, Boostified has the right to pause or disable your account. We also have the right to prevent you from registering in the future.

You have the right to terminate your membership at any time, close / delete your account or delete your data by contacting Boostified at info@boostified.com.

By using Boostified’s platform you agree that Boostified actively collects, manages, stores and uses, and otherwise processes your personal information in order for Boostified to provide the products and services provided through the Boostified website.

Boostified may hire subcontractors to perform a variety of features such as marketing, updating your tasks, e.g. through the company Creative Peoples AB and other technical services for the site. These subcontractors may in some cases gain access to the user’s personal data if necessary to enable them to perform an assignment for Boostified. Boostified handles all personal data with utmost caution and Boostified subcontractors may only use personal data to perform Boostified assignments.

Boostified can provide personal information to third parties, such as police or other authority, in the case of criminal investigations or if Boostified is otherwise required to provide such information on the basis of law or authority decision. Boostified does not transfer Personal Data to non-EU countries, but if, for example, have a subcontractor in a non-EU country or it is necessary for us to fulfill our contractual obligations towards you, transfer of personal data outside of the EU may happen even if, according to the EU Commission, the country does not have adequate protection of personal data. To ensure a high level of protection of your Personal Data in such situations and compliance with EU rules includes Boostified agreements that meet the requirements applicable law sets to protect the transferred Personal Data, with such subcontractors. Through this Privacy Policy you agree that personal data about you may be transferred to companies and organizations, both inside and outside the EU.

Through this Privacy Policy, you also agree that data / registration information is used to target audiences for marketing purposes. You may, after a written application from Boostified, get information about what personal data is registered about you. If you have any incorrect personal information, you may want to be corrected. You can also apply for personal data to be deleted. Such an application is submitted to Customer Service by sending an e-mail to info@boostified.se.

Compensation for members

We always inform the platform of the exact return each member will receive after the campaign has been completed. The exchange is determined by each business customer. In order to be eligible for compensation, the member is required to complete his commitment in the campaign according to the instructions.

In addition to each promotion’s instruction manual, always ensure that you can not remove / archive the published material afterwards, for up to 6 months or as long as you are a member. Also, you can not close your profile for the next month to private. In case the promotional material is removed, Boostified may claim the reimbursement in the form of new posts or products back to the company. In addition to each promotion’s instructions, always ensure that you do not publish xenophobic, obscure publications on your channel in the next 100 releases on your Instagram channel. Nor may publications that violate Swedish legislation contain the forthcoming 100 publications on your Instagram channel.

You undertake to transfer to Boostified and its clients each time any assignments are delivered on Instagram. The rights apply only to sharing on social media.

You may, at any time, notify us (Boostified AB) by email or letter, or directly on our website, if you wish to terminate your membership.

You may not be part of a collaboration outside our platform with a company you have had a campaign over the last 6 months through our platform. In case you are contacted privately by a company you have a campaign with within 6 months, we would like to inform you. If you include a collaboration that includes the publication of images within 3 months of your latest publication with the same advertiser through our website, Boostified owns the right to turn off or pause your account.

All our participating advertisers, companies and other stakeholders own their own statistics, their names, logos inside the platform, and may not be misused or republished elsewhere. All promotional requests you receive through our platform shall be considered confidential and in case they are spread and you may be held guilty, you may be excluded from the platform and the network without the opportunity to receive more campaign requests. Because you agree to these Terms of Use when you become a member, you will benefit from our platform, largely by giving up / off promotions, deleting your membership at any time, and contacting and chatting with us if necessary. You are also welcome at any time to contact us if you have any requests for companies you want to receive campaign requests from.

Your responsibility as a member

You must use our website in a manner that is responsible and consistent with all of these items in this agreement.

You should only apply to campaigns that are of your interest. You must give your honest opinion about the product/service and not mislead your followers or network, whether it is a product review or a post on social media.

You are solely responsible for the fact that all material you publish within the framework of campaigns complies with the instructions of the campaign. Publications may not contain requests for crimes, bullying, hanging out of convicted or non-convicted persons, against public groups, discrimination, racism, nazism, decreasing comments against minority groups, violations of any kind, breaches of the Privacy Act or the Personal Data Act, sex games, requests about buying and selling weapons, asking for the purchase of “like” markings or comments. In case you contravene any of these items you may be liable for damages and shut down from the platform.

You can not, under any circumstances, lend to Boostified account to anyone else. You have been selected exclusively as a member and membership only applies to you. All forms of login to the site are personally responsible for keeping you protected from unauthorized persons. If your login information has been compromised, we would like you to contact us immediately to block your account / update of data.

Additional responsibilities and information regarding promotions and payments.

We are not responsible for any damage you may suffer due to technical complications on our website or platform.

We are not responsible if you in your use of the service would be deemed to violate any law. You are responsible for monitoring your liability in accordance with national and international law, the Marketing Act (2008: 486) and Instagrams (or other platform: Snapchat, Facebook) regulations. You as an individual are entirely responsible for all promotional requests you assume and the content you create does not violate the law and is also responsible for any legal, contractual (and costly) consequences that may occur in cases where you have not experienced in your main areas of responsibility for each campaign .

You are responsible for the costs Boostifieds and Advertisers may incur in cases where your image causes harm to society, individuals or groups of people. In all cases when we are held against damages due to an image published by you in a campaign, the damages will be passed on to you. This may apply to all costs in the form of damages, fines or other claims that may arise from injured parties in connection with unauthorized publication in a campaign where you did not properly follow the instructions.

Boostified's responsibility

We run Boostified in the hope of creating a good meeting place where our members can find brands in exchange for products. We have a great responsibility to keep the platform clean from unsuspecting comments, ambassadors, advertisers who can be perceived as being obscene or inappropriate for the service and its contents. We are not responsible for cases in which we are subjected to attacks and the service may be down for some time or in cases where we are hacked to discontinue information. We are responsible for keeping a routine-updated backup on the entire webpage and its content but will not be responsible if our backup also disappears or is considered unpopulated with the latest statistics from completed campaigns. We are not responsible for interruptions caused by interference from internet, electricity or force majeure.

We will not censor photos or review them before publishing, which places extremely high demands on following the campaign’s instructions. If a company feels that you have not properly met the campaign instructions, Boostified will act as mediator to get both parties satisfied. In the worst case, the post may need to be redone. You agree that Boostified may monitor publications in a campaign after they have been published and that we may or may require you to immediately remove them (by removing, for example, hashtag) that we contend with the campaign instructions. or full instructions. Nonetheless, it applies if it is contrary to national or international law and whether it is perceived as discriminatory, offensive or offensive.

We can not accept any liability for any damage, loss or problem caused by failure to comply with these requirements.

It is your responsibility against Boostified and against our advertisers that if you discover any errors such as misspelled instructions or other uncertainties, you are required to notify us so that we can rectify any errors in good time before the start of the campaign. Boostified can not be held responsible for any damage that may result from such incorrect promotional information or advertiser instructions, or because of promotional material that you upload to your Instagram account.

Confidentiality

You and we (Boostified) include a privacy agreement which means that you may not distribute to anyone or republish anywhere which companies you receive requests from, which remuneration you are promised or any other information that emerges from a promotional invitation such as campaign alerts. This applies when you become a member and 5 years until your account is closed.
